SMS / MMS Mobile Messaging Marketing Program Terms
By subscribing to San Jose Real Estate Photos text notifications, you agree to receive automated marketing text messages from us about our products and services at the phone number you provided when you subscribed. Messages may be sent via an automatic telephone dialing system or other technology. Message frequency is recurring. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP, END, CANCEL, UNSUBSCRIBE or QUIT to opt-out and HELP for customer support. You may receive an additional text message confirming your decision to opt-out. You understand and agree that attempting to opt-out by any means other than texting the opt-out commands above is not a reasonable means of opting out.
Photography & Video Services
Section 01
Scheduling & Cancellations
We understand that real estate schedules can change. To respect the time of our team and other clients, we require a minimum of 24 hours' notice for any cancellation or rescheduling requests.
Cancellations / Rescheduling within 24 hours: Subject to a $50 rescheduling fee.
On-Site Cancellations / Inaccessibility: If the photographer arrives and the property is inaccessible or not ready for shooting, the full shoot fee may be charged, or a rescheduling fee will apply.
Section 02
Property Readiness
The client is responsible for ensuring the property is "camera-ready" prior to the photographer's arrival. We do not provide cleaning, decluttering, or moving services.
"As-Is" Condition: We will photograph the property in the condition it is in upon arrival.
Delays: If the photographer must wait for the property to be prepped, a fee of $50 per 30 minutes may be added to the invoice.
Section 03
Turnaround Time & Delivery
All media is delivered digitally via a secure download link or dedicated property website.
Photos: Delivered by 2:00 PM the next business day following the shoot.
Video & 3D Tours: Delivered within 2–3 business days following the shoot.
Rush delivery may be available upon request and is subject to additional fees.
Section 04
Copyright & Media Usage Rights
San Jose Real Estate Photos (SJREP LLC, operating as Skyvision Productions LLC) retains the copyright ownership of all media created. Upon payment in full, the Client is granted a License to Use the media for marketing the specific property listing.
Permitted Use: MLS listing, social media, printed flyers, and agent marketing materials.
Non-Transferable: This license is non-transferable. You may not sell, give, or loan the photos to third parties (e.g., stagers, builders, other agents) without our written permission.
Section 05
Payment Terms
Payment is required in full to download high-resolution media. We accept credit cards via our secure online invoicing system.
Late Payments: Invoices not paid within 7 days of delivery may be subject to a late fee.
Social Launchpad — Monthly Subscription
Section 06
Subscription & Billing
Social Launchpad plans (Lite, Essential, and Pro) are billed on a monthly recurring basis. By enrolling, you authorize San Jose Real Estate Photos to charge your payment method on file each month on or around your billing date.
Billing Cycle: Monthly, beginning on the date of enrollment.
Price Changes: We reserve the right to adjust pricing with 30 days' written notice. Founding Agent Rate pricing is locked for the first month only; subsequent months renew at the standard plan rate.
Section 07
Cancellation Policy
You may cancel your Social Launchpad subscription at any time. To avoid being charged for the following month, cancellation must be submitted at least 7 days before your next billing date.

No Refunds: Monthly subscription fees are non-refundable. Cancellations take effect at the end of the current billing period — you retain access to all deliverables through your paid period.
Content in Progress: Any content already in production at the time of cancellation will be delivered and billed as agreed.
Section 08
Client Responsibilities
To ensure timely content delivery, the client agrees to:
Recording Submissions: Submit self-recorded video files via Riverside within the agreed weekly window. Late submissions may delay that week's content delivery.
Feedback & Approvals: Respond to content review requests within 48 hours. Delays beyond 48 hours may push delivery to the following week.
Accuracy: Ensure all property information, farming area details, and personal information provided to us is accurate. We are not liable for errors resulting from incorrect information supplied by the client.
Section 09
Content Ownership & Usage
All finished content produced under a Social Launchpad subscription is licensed to the client for personal professional use on their own social media platforms.
Client License: You may post, share, and reuse delivered content on your own branded social media channels indefinitely.
Portfolio Use: San Jose Real Estate Photos reserves the right to use produced content as portfolio and marketing samples unless the client requests otherwise in writing.
Non-Transferable: Content may not be resold, transferred, or used by third parties without written permission.
Section 10
Distribution Add-On Terms
If you have opted into the Distribution add-on, you grant San Jose Real Estate Photos limited access to post content on your behalf to your designated social media accounts.
Access: You are responsible for granting and maintaining platform access. We are not liable for content delays caused by revoked or expired account access.
Platform Changes: We are not responsible for changes to third-party social media platforms that affect distribution or reach.
General Terms
Section 11
Limitation of Liability
San Jose Real Estate Photos shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services. Our total liability shall not exceed the amount paid for the specific service in question.
Section 12
Governing Law
These terms shall be governed by the laws of the State of California. Any disputes arising from these terms or our services shall be resolved in Santa Clara County, California.
Section 13
Changes to These Terms
We reserve the right to update these Terms & Conditions at any time. Continued use of our services after changes are posted constitutes acceptance of the updated terms. We will notify active subscription clients of material changes with at least 14 days' notice.
